Abstract
This Law regulates the plant health in general, and prescribes the necessary rules as regards all related tasks and action, in relation to plant health in general, on the territory of the Republic of Croatia. This Law states that plant health in general shall include the protection of plants, plant products and other objects from harmful organisms; determination of presence and determination of harmful organisms; prevention of the introduction and spread of harmful organisms and their suppression and eradication by applying phytosanitary measures; prevent the export of plants, plant products and other objects contaminated with harmful organisms; protecting the environment from the effects of plant based harmful organisms.
The text is divided into VIII main Chapters, and a total of 33 articles. Titles of Chapters are as follows: Introductory provisions (I); Competent authorities and legal entities with public authorization (II); Obligations of subjects (III); Official register (IV); Financing, fees, costs and payments (V); Administrative and inspection supervision (VI); Penalty measures (VII); Transitional and final provisions (VIII).
This Law establishes the competent authorities, the procedure and tasks of the competent authorities in relation to the national implementation of the terms prescribed by the Regulation (EU) 2016/2031 of the European Parliament and of the Council on protective measures against pests of plants, amending Regulations (EU) No. 228/2013, (EU) No. 652/2014 and (EU) No. 1143/2014 of the European Parliament and of the Council and repealing Council Directives 69/464/EEC, 74/647/EEC, 93/85/EEC, 98/57/EC, 2000/29/EC, 2006/91/EC and 2007/33/EC. This text further adopts the terms and provisions of the Commission delegated Regulation (EU) 2019/827 of 13 March 2019 on criteria to be fulfilled by the professional operators in order to comply with the conditions set out in Article 89 (1) point (a) of Regulation (EU) 2016/2031 of the European Parliament and of the Council and procedures to ensure that those criteria are met; and Commission Delegated Regulation (EU) 2019/829 of 14 March 2019 supplementing Regulation (EU) 2016/2031 of the European Parliament and of the Council on protective measures against pests of plants, authorizing Member States to provide for temporary derogations in view of official testing, scientific or educational purposes, trials, varietal selections, or breeding.
Competent authorities are defined and listed in article 5; expert bodies in article 6; general indications and tasks for phytosanitary Inspectors are laid down in article 8; forest inspector related provisions are in article 9, and for detailed rights, powers and measures of competent inspectors see article 21. Related compensation and its principles are determined in article 18. Article 31 sets out the list of Regulations that shall remain in force after the entry into force of this Law.
