Abstract
This Act, consisting in 20 Chapters and five Schedules establishes the basic Biosecurity Act. The main purpose of this Act is to provide a framework for an effective biosecurity system for Queensland that: helps to minimise biosecurity risks; facilitates responding to impacts on a biosecurity consideration, including responding to biosecurity events, in a timely and effective way; ensure the safety and quality of animal feed, fertilisers and other agricultural inputs; help align responses to biosecurity risks in the State with national and international obligations and requirements for accessing markets for animal and plant produce, including live animals and plants.
The Act further aims to manage risks associated with the following: a) emerging, endemic and exotic pests and diseases that impact on: (i) plant and animal industries, including agriculture, aquaculture, horticulture, fisheries and forestry industries; or (ii) the built environment; or (iii) companion or leisure animals; or (iv) biodiversity and the natural environment; or (v) tourism, lifestyle and pleasure industries; or (vi) infrastructure and service industries, including power, communication, shipping and water supplies; b) the transfer of diseases from animals to humans and from humans to animals; c) biological, chemical and physical contaminants in carriers.
The Act is divided as follows: Preliminary (Chap. I); Significant obligations and offences (Chap. II); Matters relating to local governments (Chap. III); Invasive animal barrier fencing (Chap. IV); Codes of practice and guidelines (Chap. V); Managing biosecurity emergencies and risks (Chap. VI); Registration of biosecurity entities and designated animal identification (Chap. VII); Prohibited matter and restricted matter permits (Chap. VIII); Programs for surveillance, prevention and control (Chap. IX); Appointment and powers of officers (Chap. X); Compensation for loss or damage from biosecurity response (Chap. XI); Evidence, legal proceedings and reviews (Chap. XII); Biosecurity orders and injunctions (Chap. XIII); Particular agreements between State and other entities (Chap. XIV); Accredited certifiers (Chap. XV); Auditors and auditing (Chap. XVI); Amendment, suspension and cancellation provisions for particular authorities (Chap. XVII); Miscellaneous (Chap. XVIII); Repeal, savings and transitional provisions (Chap. XIX). Schedules deal with: Prohibited matter; Restricted matter and categories and Savings and transitional provisions.
Entry into force notes
