Commission Directive 2003/90/EC setting out implementing measures for the purposes of Article 7 of Council Directive 2002/53/EC as regards the characteristics to be covered as a minimum by the examination and the minimum conditions for examining certain varieties of agricultural plant species.

Type of law

This Directive was enacted pursuant to article 7 of Directive 2002/53/EC, which requires Member States to provide that the acceptance on their national catalogues of varieties of agricultural plant species is based on the results of official examinations. Varieties of agricultural plant species must fulfill the requirements set out in article 1 in order to be included in the catalogues. The requirements refer to distinctness, stability and uniformity. As regards the value for cultivation or use, the varieties must comply with the conditions laid down in Annex III.

Member States must bring into force the laws, regulations or administrative provisions necessary to comply with this Directive by 31 March 2004 at the latest.
