Abstract
This law aims to protect the environment and human health by preventing or reducing waste generation and mitigating harmful impacts from waste management. It emphasizes the transition to a circular economy and long-term competitiveness. The law applies to various types of waste, including household, industrial, construction, and hazardous waste, but excludes specific categories such as radioactive waste and certain agricultural materials. It mandates waste classification by the Minister of Environment and Water and the Minister of Health, based on the European Commission's Decision 2000/532/EC, and includes provisions for reclassifying hazardous waste under specific conditions.
The law outlines the responsibilities of waste holders, including safe storage and non-mixing of hazardous and non-hazardous waste. It mandates that producers of products leading to widespread waste ensure separate collection and treatment, either individually or through authorized recovery organizations. Municipalities are required to organize household and construction waste management, provide waste collection containers, and ensure street and public area cleaning. The document also details the responsibilities of municipal councils and mayors in organizing waste management systems, including contracting with authorized organizations for waste collection and treatment. It emphasizes the importance of public information dissemination, preventing illegal dumping, and ensuring compliance with waste management regulations.
Additionally, the document specifies the financial responsibilities for waste management, including costs borne by initial waste producers or current holders, and outlines procedures for funding waste management infrastructure. It describes the process for obtaining permits for waste treatment activities, including submission of applications, required documentation, and conditions for permit modification or revocation. The document highlights the role of various state agencies in overseeing compliance with waste management laws and regulations, and details penalties and sanctions for violations. It also includes measures to prevent waste generation, promote high-quality recycling, and encourage the development of eco-friendly products.
