Abstract
The Law includes the following: Chapter 1, General Provisions; Chapter 2, Registration for Mineral Exploration and Examining and Approving Mineral Mining; Chapter 3, Mineral Exploration; Chapter 4, Mining Mineral Resources; Chapter 5, Collectively-owned Mining Enterprises and Mining Individuals; Chapter 6, Legal Liability; Chapter 7, Supplementary Provisions. Exploration and exploitation of the mineral resources of China shall be conducted under a concession granted by the State, which is the sole owner of those resources. The State shall be responsible for the sustainable development of the related industrial and commercial activities arising from aforesaid resources, while recognizing the rights of use, exploration and exploitation to individuals or enterprises. Aquisition of these rights shall be obtained with application and granting of a mining licence, the payment of licence fees and compensation. Transfer of rimining rights is forbidden with the exception of cases listed in Article 6 of Chapter 1.
