Abstract
This Law regulates the classification and system for the approval of standardized names and codes, permits and administrative proceedings including those regarding the violations, labelling and packaging, use and storage, placing on the market, export and import of chemicals, necessary control, inspection and registration issues, as well as other essential rules of importance for the protection of human health and of environment against the harmful effects of chemicals and chemical substances.
As defined by this Laws, the chemical is a substance in single form or in a mixture, obtained by the production process or present in its natural state; the mixture is a mixture or solution of two or more substances; the substance is a chemical element or a compound in the natural state or obtained in the production process, including additives that are necessary for maintaining its physical stability and its properties. Chemicals are classified into the following classes: explosive, oxidizing, very flammable, highly flammable, flammable, highly toxic, toxic, harmful, corrosive, irritant, chemicals that lead to hypersensitivity, carcinogenic, mutagens, reproductive toxic and chemicals that are hazardous to the environment (see article 5); article 63 prescribes the adoption of the National Strategy for Chemicals Management, as basis for adequate management of chemicals, from production or import to disposal, which will contribute to the Sustainable Development of Montenegro (necessary contents of this Strategy are as follows: assessment of the situation and problems in the field of chemicals management; priority activities and measures for the preservation of human health and the environment; mid-term and long-term national strategic objectives; priority tasks in all areas of chemical safety; action plans for implementation of the National Strategy with priorities and sources of financing).
This Law is divided into XII Chapters and 75 articles. The Chapters are: Basic provisions (I); Classification, labelling and packaging of chemicals (II); Notifications in the chain of chemicals supply (III); Registration of chemicals (IV); Free trade of hazardous chemicals (V); Export and import of chemicals (VI); Detergents (VII); Good laboratory practice (VIII); Management of chemicals (IX); Supervision (X); Penalty provisions (XI); Transitional and final provisions (XII).
The Law set sets the necessary reference in relation with chemical names according to the IUPAC nomenclature (chemical name determined by the nomenclature of the International Union of Pure and Applied Chemistry (IUPAC); sets the Prior Informed Consent principles and implements various obligations as regards the collaboration with the Rotterdam Convention Secretariat.
The provisions stipulated by this text will not affect the following: radioactive substances; chemicals that are under customs control in a customs warehouse or free zones, for the purpose of their export or transit (also if these chemicals are not processed); non-isolated intermediates; chemicals used for defense purposes; substances that can be used in the production of narcotic drugs and psychotropic substances (precursors); food and food additives; animal feed, additives and flavorings for such feedstuff; medicines for human and veterinary use; medical devices; drugs; cosmetic products; chemicals that are considered as waste in accordance with the legislation governing the waste management related activities; ammunition and explosives; plant protection products; biocidal products; chemical weapons and precursors for chemical weapons; chemicals used for scientific research and development in an amount not exceeding 10 kg for each chemical, only if not directly affecting the human health and environment; transport of chemicals in air, maritime, road, rail and postal traffic and inland waterways; (complete list of exceptions in the article 3, including the exceptions as regards the mandatory registration and data delivery).
