Abstract
The scope of the Act is to provide rules so as to enhance desirable planning, development, and operation of ports. The Act consists of 33 sections divided into 8 Chapters: General provisions (I); State organs, their tasks, and authority (II); Special management Body for ports and navigable waters (III); Geographical limits for competence of municipalities (IV); Tasks of municipalities and authority (V); Port charges (VI); Planning of ports (VII); Miscellaneous provisions (VIII).
The Act applies to the Norwegian inner waters and territorial waters and to those land areas as specified in section 14. The Department of Fisheries shall be responsible for the supervision over ports and navigable waters, including environmental aspects, and shall carry out its tasks through the Agency for Coastal Affairs. This public body consists of a directorate, district offices and all other offices subordinated to the directorate (sect. 4). Certain powers can be delegated by the Department to municipalities (sect. 5). Chapter III makes provisions for the possibility to create Port Boards in municipalities by the Department.
