Abstract
This Law establishes the competent authorities and the tasks of the competent authorities, the obligations of subjects in the food and animal feed business, official controls, and prescribes administrative measures and misdemeanor provisions. For the purpose of implementing the regulations and decisions that are here adopted (see article 2 for full list), this Law prescribes provisions at the national level that shall regulate: - competencies for the establishment and implementation of food and feed safety policy; - competencies in the field of risk analysis; - general rules of the rapid alert system for food and feed at national level; - general rules of crisis management in the field of food and feed safety; general rules for combating fraud; - establishment and coordination of a network of institutions; - providing scientific and professional opinions and providing scientific and technical assistance; national measures necessary for the implementation of food and feed safety policy.
This text is divided into seven main thematic Chapters and a total of 45 articles. Titles of Chapters are as follows: I. General provisions; II. Competent authorities; III. Special provisions (general principles of food regulations); IV. Obligations of entities in business with food and animal feed; V. Administrative supervision and official controls; VI. Penalty provisions; and VII. Transitional and final provisions. Risk assesment is defined in article 8; precautionary principle is stated in article 10; general food safety requirements are listed in article 12; Feed safety requirements are listed in article 13; for special rules for entities dealing with medicated animal feed see article 18; emergency measures are stated in article 28; article 29 sets issues regarding the crisis management.
According to the European Food Safety Agency, the Croatian Agency for Agriculture and Food is responsible for the implementation of coordination and special tasks related to the reporting of national data from special regulations regulating the methods of reporting data in the area of food and animal feed safety, except in the field of pesticides, for which the competent ministry is responsible for agriculture. The Ministry responsible for agriculture coordinates cooperation and represents a single point of contact for communication and reporting with the European Commission and other member states of the European Union and it is here designated as the main competent authority. The Ministry responsible for agriculture is responsible for the establishment of food and animal feed safety policy within the area of: - general principles of regulations on food and animal feed; - general rules of food hygiene and animal feed; - special hygiene rules for food of animal origin and animal feed; - general and special rules of official controls of food and animal feed; - microbiological criteria for food and animal feed; - food labelling, i.e. informing consumers about food; - labelling, advertising and presentation of animal feed; - traceability of food and animal feed; fraud prevention system; natural mineral and spring waters and table water; - authorization of official and reference laboratories for food and animal feed; - registration and approval of food facilities of animal origin and animal feed; medicated feed for animals; undesirable substances in animal feed; - feed for animals for special nutritional purposes; - feed additives; - residues of veterinary medicinal products; - pesticide residues in food and animal feed; - quality requirements for food and animal feed. The Ministry responsible for health is responsible for the establishment of food safety policy within the area of: - objects and materials that come into direct contact with food; contaminants in food; - food additives, flavors and food enzymes in food; - auxiliary substances in the production process, including solvents; - nutritional supplements; nutritional and health claims; - addition of vitamins, minerals and other substances to food; - food for specific groups; quick-frozen foods; foods subjected to ionizing radiation; new (novel) foods; - genetically modified (GM) food and GM animal feed; - authorizing official and reference laboratories for GM food and GM animal feed and objects and materials that come into direct contact with food.
