Abstract
This Law regulates the use, protection, conservation and capture of fish, crustaceans, shellfish, frogs and other living aquatic organisms in fresh water fishing waters. In addition it prescribes the necessary conditions for aquaculture activities on inland waters, among other issues of relevance for the freshwater fisheries sector of the Montenegro.
The Law is divided into XI Chapters and 86 articles. The Chapters are: Basic provisions (I); Fishing waters, fishing areas and fishing reverses (II); Method of granting the use of fish and other water organisms (III); Protection and keeping of fish and of other water organisms (IV); Fishing (V); Aquaculture (VI); Placing on the market of fish and of other water organisms (VII); Fishing authorities (VIII); Supervision (IX); Penalty provisions (X); Transitional and final provisions (XI).
This text sets the: definitions of fishing areas and fishing zones, protected fishing zones and areas, fishing and aquaculture permits and fishing techniques and equipment, sport or recreational fisheries, concession related issues, public participation principles, contractual and legal matters, several fish protection rules, stock re-population techniques and rules, compensation provisions, various registration obligations and catch register, sanation fishing obligations and requirements, alien species related provisions, prohibition of use of genetically modified organisms in aquaculture (article 60), inspection issues and offences and related penalties.
Fish, crustaceans, mussels, frogs and other living aquatic organisms in fishing waters, considered as goods of general interest, will enjoy special protection regimes and will be used in the manner and under the conditions determined in order to protect them and to grant their sustainable use.
Aquaculture activities can be performed only by business companies and entrepreneurs who fulfill the conditions here stipulated (aquaculture is the cultivation or breeding of fish and other aquatic organisms outside the natural habitats, in order to increase the production of these organisms).
