Abstract
There is hereby established the legislative framework on waste management. The Law makes provision on waste management plans and sets out the rights and obligations of individuals and legal entities as regards waste management. Moreover, it establishes the rules which shall govern the collection, treatment, transport, processing, storage, disposal, importation and exportation of waste. These rules are adopted in compliance with the environmental protection principle (art. 8), the precautionary principle (art. 9) and the polluter-pays principle (art. 10). The Strategy on Waste Management (art. 16) shall be implemented through the Waste Management Plan of the Republic of Macedonia (art. 17) and the Waste Management Plans of the Municipalities and of the City of Skopje (art. 18).
The following are not included in the application scope: radioactive waste; waste generated during research, exploitation, processing and storage of mineral raw materials and the working of quarries; gaseous effluents emitted into the atmosphere; wastewater, except liquid waste; animal waste and other types of non hazardous materials of natural origin used in agriculture; and decommissioned explosives and dispersing devices and materials.
The Law consists of 148 articles divided as follows: (I) General provisions; (II) Strategy, plans and programmes on waste management; (III) Waste handling; (IV) Handling of non hazardous waste; (V) Handling of hazardous waste; (VI) Landfills; (VII) Incineration and co-incineration of waste; (VIII) Import, export and transit of waste through the territory of the Republic of Macedonia; (IX) Monitoring; (X) Information system; (XI) Financing; (XII) Supervision and competent authorities; (XIII) Penalty provisions; (XIV) Transitional and final provisions.
