Abstract
This Act sets the basis for the general environmental assessment approach. This Act has the direct purpose of transposing into the legal system of Gibraltar the provisions of the Directive 2001/42/EC of the European Parliament and of the Council of 27 June 2001 on the assessment of the effects of certain plans and programmes on the environment and to provide for regulations to be made for compliance with European Union obligations.
The Act is divided into IV main parts, and 19 sections. The tiles are as follows: Introductory provisions (1); Environmental assessment for plans and programmes (2); Environmental reports and consultation procedures (3); Post-adoption procedures (4); and General provisions. Topics elaborated in these sections are: general interpretation of environmental concepts, issues and principles targeted and defined by this Act; consultation bodies; environmental assessment for plans and programmes, also those co-financed by the European Community; restriction on adoption or submission of plans, programmes and modifications to the same; determinations of the responsible authority/powers and duties of local bodies; preparation of environmental reports; consultation procedures; transboundary consultations; relation with plans and programmes of other Member States/relationship with other Community Legislation; information principles; various types of monitoring; and specific regulations relevant to the main object of the text.
This text adopts the rules and provisions aimed at respecting and introducing the contents of the following documents (list of involved European Union Legislation/International Agreements): Council Directive 75/442/EEC of 15 July 1975 on waste; Directive 79/409/EEC on conservation of wild birds; Council Directive 85/337/EEC of 27 June 1985 on the assessment of the effects of certain public and private projects on the environment; Council Directive 91/271/EEC of 21 May 1991 concerning urban waste-water treatment; Council Directive 91/689/EEC of 12 December 1991 on hazardous waste; Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora; Council Directive 97/11/EC of 3 March 1997 amending Directive 85/337/EEC on the assessment of the effects of certain public and private projects on the environment; Council Directive 97/62/EC of 27 October 1997 adapting to technical and scientific progress Directive 92/43/EEC on the conservation of natural habitats and of wild fauna and flora; and Directive 2001/42/EC of the European Parliament and of the Council of 27 June 2001 on the assessment of the effects of certain plans and programmes on the environment.
Schedules 1-3 are also part of this publication (containing the criteria for determining the likely significance of effects on the environment; information for environmental reports; Annexes I and II of Council Directive 85/337/EEC on the assessment of the effects of certain public and private projects on the environment, as amended by Council Directive 97/11/EC).
