Abstract
This Act provides rules for the management and conservation of fisheries resources and fish farming and makes provision for the protection of marine areas and habitats, the establishment of a Marine Protected Area Fund, enforcement and administration of provisions of the Act.
The Minister may declare marine areas or wetlands to be a Fishing Reserve, a Marine Park or a Marine Reserve.
Operation of a fish farm requires a permit of the Permanent Secretary of the ministry responsible for fisheries. A fish farm operator shall notify the Permanent Secretary of an outbreak of fish disease at a fish farm.
As for rules regarding fishing, the Act requires fishermen and boats to be registered, prescribes close seasons, prohibits various activities regarding fishing including unauthorized landing and prohibits the fishing for marine mammals or marine turtles.
The Act further, among other things: provides rules for the import and export of fish and the import, sale and manufacture of gear; provides for the licensing of gear and of foreign fishing vessels and Mauritian vessels; defines obligations of licensed fishing vessels regarding marking, transhipment and reporting; provides for measures of enforcement including pursuit beyond maritime zones; defines offences and prescribes penalties; and specifies regulation-making powers of the Minister.
