Abstract
This Law here regulates all basic rules and necessary requirements as regards the trade in chemicals, further determines general measures to protect human health and the environment from the harmful effects of chemicals, and prescribes obligations and procedures that must be fulfilled by legal and natural persons who use, trade, produce or store chemicals on the territory of the Republic of Slovenia.
The text is divided into seventeen main thematic Chapters and a total of 78 articles. Titles of these Chapters are as follows: I. General provisions; II. Chemical safety; III. Registration of new substances; IV. Placing biocidal preparations on the market; V. Evaluation of chemicals; VI. Classification, packaging and labelling of chemicals; VII. Notice obligation; VIII. Production, storage and use of dangerous chemicals and their traffic; IX. Protection of human health and the environment; X. Good laboratory practice; XI. Exchange of information and expert advice; XII. Costs; XIII. Authority responsible for chemicals; XIV. Cooperation of customs authorities; XV. Inspection control; XVI. Penal provisions; and XVII. Final and transitional provisions.
The provisions of this Law shall be applied to: the production of strategic goods of special importance for safety and health and their trade, insofar as they are not regulated by a special law; production and trade of precursors for illicit drugs, insofar as they are not regulated by a special law; radioactive substances containing dangerous substances according to this Law. The provisions of this text also apply mutatis mutandis to dangerous products for which the Minister responsible for health determines, based on the assessment of the expert referred to in article 57 of this Law, that they may harm humans or the environment during normal use. All legal and natural persons who meet the conditions under this law for the production, storage or trade in chemicals and everyone who uses or handles them must ensure chemical safety. To ensure chemical safety and perform professional and development administrative tasks as well as tasks of inspection and other control, the Government of the Republic of Slovenia establishes a body in the composition of the Ministry responsible for health. The assessment of chemicals is carried out by the authority responsible for chemicals. In doing so, it can cooperate in individual specific areas of expertise with health and other public institutes and with experts authorized by the minister at the proposal of the body responsible for chemicals. For the purposes of evaluating substances at the international level, the minister nominates experts to competent international bodies. Legal and natural persons who produce a hazardous chemical in the Republic of Slovenia or import a hazardous chemical into the Republic of Slovenia must submit the data from the safety data sheet, the chemical composition, for each hazardous chemical and for each hazardous to the body responsible for chemicals. dangerous chemical or dangerous product, and information on areas of use. The data from the safety data sheet must be submitted to the body responsible for chemicals no later than the first release of a dangerous chemical to a third party or the first introduction of a dangerous chemical into the Republic of Slovenia, and the chemical composition of the dangerous chemical and data on the areas of use no later than March 31 of the following year after the first release the third or first introduction of a dangerous chemical into the Republic of Slovenia. The method of submitting and renewing data, as well as exceptions to reporting, is prescribed by the minister. According to this law, the authority responsible for chemicals has in particular the following tasks and powers: 1. accepts or requests proof of the properties of substances or preparations in accordance with regulations (Article 35); 2. manages procedures for the evaluation of chemicals and proposes to the Minister for the appointment of health and other institutes and experts for the evaluation of chemicals (Articles 24 and 57); 3. maintains a list of substances, preparations and dangerous products for which there is an obligation to notify (Article 35); 4. prepares reports for bodies and international organizations to which the Republic of Slovenia is obliged to report in accordance with this law and on the basis of international agreements (Article 55); 5. accepts proof of compliance with the conditions for the production, storage and use of dangerous substances and preparations, as well as trade in them, issues permits for carrying out activities and keeps a list of legal and natural persons with permits for the production, storage and use of dangerous chemicals and trade in them (44 . and Article 44a); 6. coordinates the training of chemical advisors and other types of training that take place on the basis of this Law (Article 45a); 7. receives and manages information related to the storage of DLP documentation and the issuance of DLP - certificates and takes care of DLP assessment (Articles 53 and 54); 8. maintains a list and publishes a list of laboratories performing tests in accordance with good laboratory practice on its website with each change (Article 55); 9. coordinates the work of the interdepartmental commission (Article 56); 10. coordinates information support in the field of chemicals, which includes all authorities responsible for hazardous substances, with the collections (databases) they have, organizations that have their representatives in the interdepartmental commission, and research organizations that have data at their disposal on dangerous chemicals (Article 58); 11. provides certain information to all competent authorities and services that have jurisdiction in the field of dangerous chemicals or need this information for their work, such as the State Statistics Authority, customs authorities, occupational safety authorities and services, health care units, authorities and services for environmental protection, and authorities for protection and rescue, etc.; 12. participates in the preparation of international agreements concluded by the Republic of Slovenia in the field of dangerous chemicals, especially agreements in the field of mutual recognition of data and cooperation in the field of chemical safety, and ensures their implementation; 13. prepares expert materials for regulations in the field of hazardous chemicals issued by the Government of the Republic of Slovenia or the Minister, and ensures their implementation; 14. issues consent for trade in phytopharmaceuticals intended for use in the Republic of Slovenia (Article 49a); 15. coordinates biomonitoring of chemicals (Article 51a); 16. performs other duties specified by related legislation in force.
