Abstract
This Act: makes provision for various matters relating to the management of sea fisheries and conservation of fish resources in specific areas of the sea, for the appointment and powers of Sea-Fisheries Protection Officers and for matters relating to indictable fishery offences; provides for the establishment of the Sea-Fisheries Protection Authority and defines functions and internal organization of the Authority; provides for the registration of sea-fishing boats; defines the extend of the internal waters, territorial sea, contiguous zone, exclusive economic zone and exclusive fishery limits of Ireland; defines maritime jurisdiction of Ireland and provides for related matters; provides with respect to offences in the maritime areas; and amends and repeals various other enactments. The Act consists of 104 sections divided into 4 Parts.
The Act grants power to the Minister to make Regulations in respect of all matters provided for in Part 2 of this Act regarding the management and conservation of fish resources in marine waters including the Moville Area and the Louth Area. Provisions of Part 2 implement common (EC) fisheries policy in these areas, regulate access by foreign fishing boats and allocation of fishing rights, provides for appointment of Sea-fisheries Protection Officers for the purposes of the Sea-Fisheries Acts 2003 and 2006 and defines their powers in respect of offences and establishes the Sea-Fisheries Protection Authority as a body corporate. The principal function of the Authority is to secure efficient and effective implementation and enforcement of sea-fisheries law and food safety law. It shall also advise the Minister on these matters and represent the State internationally. A Seafood Control Manager shall be part of the Authority. The Register of Fishing Boats continues in existence as the Register of Fishing Boats (“Register”) for the purposes of this Act and shall continue to be maintained by the Registrar General of Fishing Boats in such form as he or she considers appropriate. Apart from the Registrar General and Deputy Registrar General there shall be local registrars of sea-fishing boats. The Act requires Irish sea-fishing boat to be entered into the Register and regulates the procedure of registration.
The Act defines, in Part III, baselines and the extent of the internal waters, territorial sea, contiguous zone, exclusive economic zone and exclusive fishery limits of Ireland and defines sovereign rights and jurisdiction of the State in respect of each of the maritime areas.

An Act to revise with amendments Part XIII of the Fisheries (Consolidation) Act 1959 and the Maritime Jurisdiction Acts 1959 to 1988, to provide for the establishment of a body to be known in the Irish language as An T-U´ Dara´ S Um Chosaint Iascaigh Mhara, or in the English language as the Sea-Fisheries Protection Authority, and to define its functions, to amend and extend the Fisheries Acts 1959 to 2003, the Mercantile Marine Act 1955, the Fishery Harbour Centres Act 1968, the Dumping At Sea Act 1996 and the Maritime Safety Act 2005, to amend or repeal certain enactments and to provide for connected matters.
