Abstract
This Royal Ordinance aims to reorganize fisheries in Thailand and in waters at large with a view to preventing IUU fishing in order to preserve aquatic animal resources as a sustainable source of food for humanity and preserve the environment, as well as to protect the welfare of seamen and prevent all forms of forced labour in the fisheries sector.
The 176 Sections of the Act are divided into a title part (sections 1 to 7) and 11 Chapters:General Provisions (I); Fisheries Management (II); Fishing Operations in Thai Waters (III); Fishing Operations outside Thai Waters (IV); Conservation and Management Measures (V); Aquaculture Promotion (VI); Control, Surveillance, Traceability, and Inspection (VII); Hygiene Standards of Aquatic Animals or Aquatic Products (VIII); Competent Officials (IX); Administrative Measures (X); Sanctions (XI).
No person shall use a stateless vessel in their fishing operations (Sec. 10). The National Fisheries Committee shall be established. The duties of it are described in Section 19, including: determining policies for the development of fisheries in Thai waters; determining policies for the promotion, development and resolution of problems pertaining to fisheries outside of Thai waters; determining approaches to the management of aquatic animal resources to maintain appropriate conditions and sustainable fishing; determining the total allowable catch for fishing operations within Thai waters; etc. Measures and approaches issued pursuant to section 19 shall cover, among others, measures to prevent and deter the support of IUU fishing, measures for the supervision and control of fishing operations in line with the international law and standards, an approach to the safeguard and protection of rights, as well as the development and promotion of occupations and livelihood of Thai fishermen. A Fisheries Management Plan shall be developed by the Department of Fisheries.
In the case where evidence based on a point of reference shows that the maximum aquatic animal reproductive capacity is not adequate for the attainment of sustainable fishing operations, the Minister of Agriculture and Cooperatives shall issue a notification suspending the issuance of fishing licenses temporarily (sec.45). In order to use a Thai vessel for the purposes of fishing outside Thai waters, a license to fish outside Thai waters shall be obtained (sec.48). For the purposes of protecting rare aquatic animal species or preventing danger caused by an epidemic disease, the Minister of Agriculture and Cooperatives shall have the power to prohibit the importation, exportation, bringing in transit, culturing or possession of any kind of aquatic animal (Sec.65).
