Abstract
This Law regulates the conditions for food safety and hygiene and safety of animal feed, obligations and responsibilities of food and feed business operators, including those regarding the traditional products, as well as other issues of importance for the safety of food and feed (such as HACCP), all aimed to protect the lives and health of people, the environment, the consumers and the efficient functioning of markets. This Law shall apply to all stages of production, processing and distribution of food and feed. As defined by this text, the food is divided into two separate categories: animal origin food; and non-animal origin food.
This text also provides for provisions and rules aimed at controlling and implementing the following issues as regards the food safety topics: competent national and local authorities, their duties and relations; competencies of the Ministry in charge and necessary cooperation with other institutions; creation process as regards the new Regulations on the prevention of food or feed related consequences; principle of risk analysis and risk management; precautionary approach; consumer protection; transparency principles; specific food hygiene requirements; informing the public; import and export of food and feed; ban on placing food on the market; various prohibitions and market bans for food and animal feed; presentation of food and feed; establishment of the rapid alert and notification systems; emergency measures; crisis management; various educational issues; specific microbiological criteria for food; removal of surface contamination; various registration obligations; instructions and guides for good practice; consumer informing about food; nutrition and health claims; additives; food enzymes; extraction solvents; food flavorings; materials and articles that come into contact with food; adding vitamins, minerals and other food substances; food for special dietary needs; fast frozen foods; contaminants; new food; foods and food ingredients treated with ionizing radiation; natural mineral water; genetically modified food or animal feed; methods, techniques and organization of official controls; obligations, methods and laboratory tests in authorized laboratories; border control; treatment of food that does not meet the requirements; official certification; and various offense, financial penal provisions and measures
The Law is divided into XV Chapters and 132 articles. Chapters are: Basic provisions (I); Authorities for food safety (II); Principles of food safety (III); Export and import (IV); General requirements for food safety (V); Rapid alert system and notification (VI); Conditions for placement of food and feed on the market (VII); Special rules for animal feed (VIII); Official controls (IX); Official controls over the imports of food and feed (X); Fees and charges (XI); Control planning (XII); Supervisions (XIII); Offences and penalties (XIV); Transitional and final provisions (XV).
